Terms of Service

By accessing or using Withly (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must stop using the Service immediately.

Eligibility

You must meet the minimum age required by the authentication provider you use:

• Apple Sign-In: 13 years old or older
• Google Sign-In: 13 years old or older

(Some regions may require a higher age under local laws.)

By using the Service, you confirm that you meet the minimum age requirement.

User Accounts

You may sign in using Apple or Google accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Personal Data & Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our processing of your personal data in accordance with that policy.

We only collect:

• Email (required for login)
• Nickname
• Optional data for personalized ads
• Bucket list items, tags, notes, and other content you create

User-Generated Content

Ownership: You retain full ownership of all content you create or upload (“User Content”).

License to the Service: By using the Service, you grant Withly a limited, non-exclusive, revocable license to store, process, and display your User Content solely for the purpose of operating and improving the Service (e.g., syncing, backups, customer support). We do not use your content for marketing, advertising, or public purposes.

Responsibility: You are responsible for the content you create. You agree not to upload content that is illegal or violates the rights of others.

Advertising

The Service may display ads, including personalized ads based on optional data you agree to provide. You can withdraw your consent for personalized ads at any time.

In-App Purchases (Future Feature)

The Service may introduce paid features in the future. Specific payment terms, refund policies, and subscription rules will be provided when such features launch.

Prohibited Activities

You agree not to:

• Reverse engineer, copy, or modify the Service
• Use the Service for illegal or harmful purposes
• Interfere with server security or the operation of the Service

Account Deletion & Data Retention

You may delete your account at any time. When you request deletion:

• Personal identifiers (such as your email and nickname) are retained for 30 days to prevent accidental deletion and resolve disputes, and then permanently deleted.
• Content you created within a shared couple space (such as bucket list items, or reviews) will remain available to your partner even after your account is deleted, as it forms part of the shared record.

After deletion, your personal profile information will no longer be visible, and you will no longer be identifiable within the Service.

Service Availability

We may modify, suspend, or discontinue parts of the Service at any time. We are not liable for any loss caused by service interruptions.

Limitation of Liability

To the maximum extent permitted by law, Withly is not liable for:

• Loss of data
• Indirect, incidental, or consequential damages
• Issues caused by third-party login providers (Apple/Google)

Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.

However, if the laws of your country provide mandatory consumer protection rights, those rights will take priority over this clause.
